A variety of searches may be carried out, either on their own or as part of the compilation of a file leading to the transfer of immovable property, for example, by exchange or sale, the granting of a loan, or the settlement of a succession.

Public Registry Searches
These searches reveal a person’s past transfers and acquisitions of immovable property, any secured obligations in their name, and whether ground rent on a property has been redeemed through a court deposit. Certificates of birth, marriage, death, and Free Status Certificates for cohabitation can also be obtained from the Public Registry.

Land Registry Searches
These are used to confirm transfers, charges, or burdens affecting a specific immovable property. They are conducted using an official plan from the Land Registry, marked by an architect. Not all properties in Malta are registered in this registry.

Testamentary Searches
A testamentary search in the Public Registry determines whether a person, living or deceased, made a public will. A search in the Civil Court (Voluntary Jurisdiction Section) determines whether a deceased person left a secret will.

All these searches assist buyers, lenders, heirs, and legal professionals in making informed decisions and ensuring transparency in property and succession matters.
